We inform that form 25th of May 2018 we are using new rules about privacy policy - RODO (GDPR) General Data Protection Regulation and European Council 2016/679 from 27.04.2016.
This Privacy Policy defines the methods of using and protecting personal data of Customers using the website www.vandermoon.com, hereinafter referred to as the "VDM website".
§ 1. Personal data administrator
Administrator of personal data of Vitberg clients is Vitberg Jacek Sikora , with its registered office in Nowy Sacz at Borelowskiego 29 st. NIP: 734-100-9112 later called “VDM”.
§ 2. Way of collecting data
The Customer's personal data is provided by VDM website users voluntarily in order to use the services offered by the VDM website through it. Failure to provide certain data may limit the possibility of using the VDM website or certain services. The above data is processed on the basis of the Customer's consent, which is granted by checking the appropriate box on the order form and the registration form for an individual Customer Account or Distributor Account. VDM collects such customer data as: name and surname, e-mail address, delivery address. When the Customer sets up an individual Customer Account on the VDM website, he may be asked to provide additional data, such as a telephone number. The Administrator undertakes to maintain confidentiality related to personal data, adequate protection against access by third parties and use contrary to this privacy policy. The Administrator undertakes to make efforts to maintain proper protection of the Customer's personal data.
§ 3. Cookie files
By using the VDM website, the Customer agrees to the use of cookies in order to provide him with comfort while browsing the VDM website. No cookie files used on VDM websites collect information enabling identification of the user. VDM uses the Google Analytics service, which has its own privacy policy: Google Analytics Privacy Policy.
What is cookie?
In today's world, virtually every website uses cookies. They consist of small text files stored on the User's end device. They are created by your web browser and store the settings and information needed (and often necessary) for the proper functioning of the website. § 4. Purpose and time of data processing
All data provided by the Customer or Distributor will be processed by VDM in order to fulfill the order and use the individual Customer or Distributor Account, including to ensure contact between the Customer and VDM. Also in order to inform the Customer about VDM products, services and promotions and to pursue claims for business activity, to the extent that it does not violate the provisions of the Act of May 10, 2018 on the protection of personal data (i.e. Journal of Laws of 2019 of 1781).
Depending on the consent given by the Customer or the Distributor, the personal data provided, in particular the e-mail address and mobile phone number, may be used by VDM to send a free newsletter containing commercial information within the meaning of the Act of 18 July 2002 on the provision of electronic services ( i.e. Journal of Laws of 2020, item 344). Consent to subscribe to the newsletter may be withdrawn at any time. To do this, use the link attached to each message sent to our client as part of the newsletter.
The Customer and the Distributor have the ability to decide to what extent their personal data will be used. In particular, he may submit a declaration of will withdrawing consent to receive the newsletter. The Customer and the Distributor have the right to supplement, update, rectify personal data, temporarily or permanently suspend their processing or delete them if they are incomplete, outdated, untrue or have been collected in violation of the law or are no longer necessary to achieve the purpose for which they were collected and the right to raise objections, in cases provided for in the GDPR, also when VDM intends to process data for marketing purposes or transfer them to another data administrator.
Personal data will be stored for the duration of the contract and for a period in accordance with applicable regulations, taking into account the statute of limitations for claims and tax liabilities. Personal data for the processing of which you have consented will be stored until you withdraw your consent.
Any changes in the scope of his personal data can be made by the Customer by sending a proper declaration of will to the e-mail address biuro@vitberg.com or to the following address: Vitberg, ul. Borelowskiego 29, 33-300 Nowy Sącz. Vitberg reserves the right to refuse to delete the Customer's data if their retention is necessary in order to pursue claims or if required by applicable law.
§ 5. The right to view, correct and delete personal data
The Customer may access this Privacy Policy (or the Regulations) at any time via the link on the website www.vandermoon.com and print it out. Consolidation, security, disclosure and confirmation to the Customer of the relevant provisions of the contract for the sale of goods and services takes place by sending the Customer and the Distributor to the e-mail address provided and by attaching a printout of the confirmation, order specification and receipt (VAT invoice) to the shipment containing the order. Vitberg declares that it processes personal data in accordance with the GDPR and the Personal Data Protection Act and that it applies technical and organizational measures to ensure the protection of processed data appropriate to the threats and categories of data protected, and in particular protects the personal data of Customers and Distributors against making them available to persons not authorized persons, loss or damage.
The user has the right to inspect and change his personal data at any time, as well as to request the Administrator to immediately remove them ("the right to be forgotten").
§ 6. Sharing personal data with third parties
Only authorized employees or associates of VDM and authorized persons responsible for servicing the VDM website, who have been granted appropriate powers of attorney, have direct access to personal data collected by the VDM website.
VDM may share the Customer's collected personal data with cooperating entities, such as: courier companies, payment companies in order to fulfill the Customer's order. In such cases, the amount of data transferred is limited to the required minimum.
Your personal data may be transferred to the payment operator and courier company.
In addition, the information provided by the Customer may be made available to competent public authorities, if required by applicable law.
§ 7. Discalimer
VDM is not responsible for the actions or omissions of Customers or Distributors, as a result of which VDM processes the personal data provided by them in the manner specified in this Privacy Policy.
§ 8. The right to lodge a complaint with the supervisiory authority
You have the right to lodge a complaint with the supervisory body dealing with the protection of personal data - the President of the Office for Personal Data Protection.

In matters not covered by the regulations, the provisions of the Civil Code and relevant acts of Polish law, as well as European Union law, in particular the GDPR (Regulation of the European Parliament and of the Council (EU) 2016/679 of 27 April 2016 on the protection of natural persons in connection with with the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC).
